Biography

Marian B. Rush is a civil litigator who has been in practice since 1983. She has extensive experience as a commercial litigation attorney and currently serves the City of Alachua as City Attorney.

Marian B. Rush is a Board-Certified expert in city, county, and local government law, but is also an accomplished car accident attorney and handles many civil lawsuit issues, including commercial disputes.

Marian B. Rush is the younger sister of the firm’s founder and has been practicing law since 1983. She has received the highest rating of her peers by Martindale Hubbell, receiving a perfect score of 5 out of 5 for her A-V rating, the highest rating available.

She began her legal career at a large law firm in St. Petersburg, handling a wide variety of matters including insurance coverage and defense, including auto and truck accidents, construction litigation, products liability and medical malpractice cases, along with handling commercial and residential closings, garnishments, and foreclosures for banks. The firm was general counsel for several banks, and Ms. Rush not only did residential and commercial closings, she also handled a major fidelity bond claim upon an employee’s dishonesty which was litigated in federal court. She handled most of the firm’s appellate cases, including arguing two cases in front of the Florida Supreme Court.

Because of her extensive work in the area of banks and banking regulations, in 1991 she was hired as a senior attorney by the Federal Deposit Insurance Corporation to primarily handle professional liability claims against the professionals of failed financial institutions arising out of fidelity bond claims, director and officer’s liability, attorney malpractice, accounting malpractice, appraiser malpractice, and security and commodity broker negligence throughout the State of Florida. She evaluated the feasibility of bringing lawsuits, retained and supervised outside counsel, developed case strategies, issued administrative subpoenas, and interacted with other offices and agencies, including the, FDIC, OTS and the U.S. Attorney’s Office throughout the United States and in Washington, DC.

Ms. Rush then returned to private practice at a mid-sized Tampa firm where she quickly became partner and supervised attorneys and paralegals handling state-wide litigation in federal and state courts on behalf of the Federal Deposit Insurance Corporation and other clients. Her efforts in handling cases involving failed savings and loans resulted in the recovery of more than ten million dollars for the tax payers. As an authorized agent of Attorneys’ Title Insurance Fund and Chicago Title Insurance Company, Ms. Rush also participated in a commercial real estate auction and the replating and refinancing of a fifty million dollar multi-use project.

In 2001, Ms. Rush moved to Gainesville and joined her big brother’s flourishing law practice bringing a depth of experience in commercial litigation, insurance disputes, and financial and transactional work. Because of the depth and breath of her experience in governmental, administrative, transactional, and litigation work, in 2003 Marian was chosen by the City of Alachua to be the City Attorney. She feels both proud and privileged be serving in this position. As the City attorney she advises the City Commission and its many Boards, including the Planning and Zoning Board and Downtown Redevelopment Board,, handles day-to-day items with the City Manager, handles or oversees outside counsel in a wide variety of cases from auto accidents to constitutional challenges to ordinances, employment issues, public records and public meetings issues, and whatever items come across the City Manager’s desk. She has received Board Certification from The Florida Bar in City, County, and Local Government Law.

Over the past 30 years, Marian has participated in more than 15 trials in state and federal court. This includes numerous several trials between two and three weeks in duration. She has also participated in 23 appeals in Florida’s First, Second, and Fifth District Courts of Appeal, and the Eleventh Circuit Court of Appeal. She is also admitted into practice in front of the United States Supreme Court.

Marian is also an avid football fan of both professional and college teams. She attends Tampa Bay Buccaneer games on a regular basis. Since moving to Gainesville, Marian is a devoted Gator fan and attends most home games and gets to away games when possible.
